Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of moveapp.ai, an AI-powered fitness coaching platform operated by Cockpit Mobile, Inc. (“moveapp.ai,” “we,” “us,” or “our”). The Service includes our mobile application, website at moveapp.ai, AI coaching features, activity tracking, and all related services (collectively, the “Service”).

By creating an account, downloading our app, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years old (or 13 years old with verifiable parental or guardian consent) to use the Service. By using the Service, you represent that you meet these requirements and are capable of forming a binding legal agreement.

3. Account Registration & Security

You may create an account using your email address or by signing in through Google or Apple. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when creating your account and to update it as needed. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

5. AI-Generated Content & Limitations

The Service uses artificial intelligence to provide coaching via text chat, real-time voice conversations, personalized workout plan generation, and audio-guided coaching. AI-generated content is produced by third-party AI models (including Anthropic Claude and OpenAI) and may contain errors, inaccuracies, or inappropriate responses.

You acknowledge and agree that:

• AI coaching is for informational and motivational purposes only and does not constitute medical, fitness, nutritional, or health advice from a licensed professional
• AI-generated workout plans and suggestions may not be appropriate for your specific fitness level, health conditions, or physical limitations
• AI responses may occasionally be inaccurate, incomplete, or inconsistent
• You are solely responsible for evaluating the suitability of any AI-generated content before acting on it
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content

6. AI Credits & Usage

The Service includes a monthly AI credit system. AI credits are consumed when you use AI features such as text coaching chat, voice coaching, and workout plan generation. Credits reset monthly.

If you exhaust your monthly AI credits, access to AI-powered features may be limited or temporarily unavailable until your credits reset at the beginning of your next billing cycle.

We reserve the right to modify the credit allocation, consumption rates, and reset schedule at any time.

7. User Content & Data

You retain ownership of the personal data and activity information you provide to the Service (e.g., workout logs, chat messages, fitness profile data). By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit this data as necessary to operate and improve the Service, including sharing it with our AI providers for the purpose of generating coaching responses and workout plans.

AI-generated content (workout plans, coaching responses, audio phrases) is provided to you on an “as is” basis for your personal use within the Service. We retain ownership of the underlying AI systems and models.

8. User-Generated Content & Community Standards

The Service allows users to upload photos, including selfies, as part of fitness challenges and activity verification. By uploading a photo, you grant us a non-exclusive, royalty-free license to display that photo within the Service to other users participating in the same challenges or groups.

We have zero tolerance for objectionable content or abusive users.

You agree that any content you upload will not:

• Contain nudity, sexually explicit material, or pornography
• Depict violence, gore, or graphic content
• Include hate speech, discriminatory language, or symbols
• Harass, bully, or target any individual
• Contain illegal content or promote illegal activity
• Impersonate another person or misrepresent your identity
• Include spam, advertising, or content unrelated to fitness activities

Reporting & Blocking: If you encounter objectionable content or abusive behavior, you may block the offending user or report the content directly within the app. We will review all reports and take appropriate action, including removing content and suspending or permanently banning offending accounts.

Moderation: Our team actively monitors and moderates user-generated content. We reserve the right to remove any content that violates these standards at our sole discretion, without prior notice. Repeat or severe violations will result in immediate account termination.

9. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to obtain medical diagnoses, treatment recommendations, or prescriptions from the AI coach
• Attempt to manipulate the AI to produce harmful, abusive, or dangerous content
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to access the Service (bots, scrapers, crawlers)
• Share your account credentials or allow others to access your account
• Harass, abuse, or harm other users through community features
• Upload or transmit viruses, malware, or other malicious code
• Reverse-engineer, decompile, or attempt to extract the source code of the Service

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information, including data shared with AI providers. Please review it carefully.

11. Intellectual Property

The Service and its original content (excluding user-provided content), features, functionality, branding, and underlying technology are and remain the exclusive property of Cockpit Mobile, Inc. and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

12. Third-Party Services

The Service relies on third-party providers for AI processing, authentication, payment processing (via app stores), analytics, and email delivery. These third-party services are provided “as is” and we are not responsible for their availability, accuracy, or performance. Your use of the Service through app stores is also subject to the terms and policies of Apple and Google, as applicable.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR APPROPRIATE; OR THAT DEFECTS WILL BE CORRECTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COCKPIT MOBILE, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the Service
• Any injury, illness, or health condition resulting from exercise, workouts, or activities undertaken in connection with the Service
• Any errors, inaccuracies, or omissions in AI-generated content, workout plans, or coaching recommendations
• Unauthorized access to or alteration of your data
• Any third-party conduct or content on the Service

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Cockpit Mobile, Inc. and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

16. Termination

You may stop using the Service and close your account at any time. To delete your account and data, email [email protected]. Cancellation of your subscription must be done through your app store settings.

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) shall survive.

17. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.

18. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforceable to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
